    Depending on what state you live in - You CAN collect unemployment even if you quit. If you have to quit - through no fault of your own - ie a medical condition - you DO qualify for unemployment in some states.

    I like peggoins recommendation - ask them for a letter confirming your mutual decision to stop your employment due to the medical circumstances beyond your control...or something like that. Maybe your HR dept will be able to offer some help. At the very least I'd see if they were willing to give you a written recommendation on the great work you did for them while you were there.

    It sounds like you've been very happy with the way they've worked with you, so there's no reason this needs to be a battle. Let them know how much you've enjoyed working with them. Leave the bridges intact if possible.

    There is a glimmer of hope for me! HR told me that if we can get a written statement from my doctor about my most recent issues, as well as information about my MM/MAV in general that they will possibly see if they can make an exception for me with the attendance requirements. It's in no way a for sure thing but it's definately worht a try!

    I know you are worried about how being fired looks on your resume. But If they fired you it would not be because of you work performance. And it would not look like you were not able to do the job.

    I worked for Unemployment Insurance and I know that many people get fired because they do not do their jobs. But if you were fired because of you disease it is against the law to discriminate.

    Equal Oportunity Employment might be able to help you on that issue. Do you have that available.

    Legal Aid might be able to provide you with a attorney at a lower cost.

    I know it sounds very upsetting. But I think being able to get benefits is important.

    I hope that you can get some help on this issue.

    I hate to say these things but from someone like me, who has seen every excuse to deny people unemployment benefits in the book this is worth warning you. I worked there for 25 years.

    I had another thought. If you are fired, your employer may try to deny you unemployment insurance on some other complaint to get out of paying you. It is an old trick. And your employer may give you a bad recomendation if you do quit. So you are in a no win situation.

    Iwould try to stick it out and let them fire you because your employment reputation is in danger no matter what you do. But it looks to me like your employer has tried to squeeze you any way you look at it. I would rather you got your Unemployment benefits. You earned them.

    Talk to an attorney about this. Sorry you are in this problem.

    it sounded like you were caught between a rock and a hard place in the beginning, but your last post sounds pretty promising. i wish you the best of luck with what ever rout you take. its your decision and no one can make you do something that you don't want to do (except your boss) i'm sure thing will work out for the best. good luck

    As an employer, I would advise you to make them let you go. Even tho we are a hire or fire at will state there are still rules we must follow, and firing someone because they are sick or pregnant are major no,no's. Your employer cant even ask those questions in the interview process. You could probably sue and win against the company just because your boss made that suggestion.

    I hate people like that they give us all bad press. There are defiantly good companies out there.

    Myself? I would allow them to fire me and I would protest by writing a letter to the firm.

    Just got done faxing a letter to my doctor about the situation. Hopefully they'll get right on it and send a response quickly to my employer.

    I am more sorry than I can say that this happened. A Migraine bud of mine was in a similar situation about this time last year--"quit or be fired" over his attendance due to Migraine attacks.

    Have been there. Chose to protect my reference so when or if am ready to go to another job can have a good chance. I found it helped as soon as someone in my case from the Union was there to advocate for me. My bosses were very worried and didn't actually know how to go about the process properly to protect them and my future. It was hard for both parties I think. I am still friends with some people that work there and know that my old boss still asks after me, even though we moved to the other side of the country.

    Good luck and I hope the suppport and care shown by everyone on this board even if we would make a different descision gives you the inner strength you need right now.

    I'm doing a little bit better. I'm off for my weekend, only work Mon. - Thur., so I'm taking advantage of following up with my specialist and seeing that she got the fax. Also taking care of some other things, getting some rest, and hopefully some fun tonight if I'm up to it.

    If you can stay on that will be good. If you think that your employer was fair with you and you would rather get a good reference than to fight them then go with what you want. Too many people at this site take things personally and would rather fight anyone and everything than to rationalize the situation. You still have your Mom and Dad's support and that means a lot in moving forward. Do what makes sense to you.

    I'm in a simalar postion. My employer has been great working with me and my condition. They're allowing me to work from home whenever possible. They're cutting me a lot of slack for the time I miss. But I know it won't last forever and I will have to do something soon.

    My biggest problem is I have not yet been diagnosed with Meniere's. But over the past few weeks I've developed tinnitus in both ears (was only in my right ear when I first came to this site) and I've started experiencing full fledged vertigo which I wasn't before. I spend pretty much every day fatigued and unable to get around. And nearly every night I wake up with the room spinning and feeling like I'm going to throw up.

    My doctor has a few tests planned for me but the machine they use for these tests are not working and I'm waiting for them to get it repaired. I'm hoping after those tests I can start the process of filing for disability. The idea of doing so just makes me cringe. But it's clear to me that even if I don't have MM, I definitely have something going on that prevents me from doing my job on a regular basis.
